Terms of Service

These Terms of Service govern the use of the Webfy platform (accessible at www.webfy.pt) and the associated website creation, hosting and support services. By registering, contracting a plan or using any functionality of the platform, the user fully accepts these terms.

1. Definitions

  • Webfy — the entity that operates the platform and provides website creation, hosting and technical support services.
  • Client — a natural or legal person who registers on the platform and/or contracts a website creation plan.
  • Platform — the website webfy.pt, including the client dashboard and administration panel.
  • Site — the website created by Webfy for the Client, hosted on Webfy's infrastructure.
  • Plan — the website creation package contracted by the Client (Starter, Pro or Custom). The Premium plan was discontinued in 2026 but remains active for clients who contracted it before that date.
  • Hosting — the hosting service for the Site on Webfy's servers, available in free or paid modes.

2. Purpose and Scope — Free Demo Model

Webfy provides professional website creation, integrated systems and bespoke digital solutions for businesses and entrepreneurs. The working model is based on a free pre-payment Demo, organised in 4 phases:

  • Phase 1 — Briefing: the Client creates the project and completes the briefing (with our AI assistant OR directly through a call with the Team).
  • Phase 2 — Free Demo: the Webfy Team delivers a real, functional Demo (1st page of the site) at a temporary URL, at no cost to the Client.
  • Phase 3 — Client Decision: the Client approves or rejects the Demo. Pays only if happy with it.
  • Phase 4 — Payment and continuation: after plan payment, the Client chooses between publishing the Demo immediately, requesting changes or scheduling a refinement call.

Included within the scope of services: website creation based on the Client's briefing; hosting of the Site (free or paid) after Demo approval and payment; technical support via WhatsApp and ticket system; basic maintenance and updates of the hosted Site.

3. Registration and User Account

To use Webfy's services, the Client must create an account providing truthful and up-to-date information. The Client is responsible for maintaining the confidentiality of their login credentials and for all activities carried out on their account.

Webfy reserves the right to suspend or close accounts that violate these terms, contain false information or are used for illegal purposes.

4. Plans and Pricing

Webfy offers the following website creation plans, with one-time payment:

  • Starter — €197 (1 page with up to 6 sections, gallery, contact, WhatsApp, Maps, FAQ, GDPR, essential SEO)
  • Pro — €497 (up to 5-6 pages with blog, multi-language, simple booking, team page, testimonials, Google Reviews, 1 year maintenance)
  • Custom — price defined case by case for e-commerce, integrated systems, web applications and complex projects

Prices include VAT where applicable. Webfy reserves the right to change prices at any time, provided that changes do not affect plans already contracted and paid for.

Binding prices: only the prices published on the official /precos page or communicated by the Team in a direct proposal are considered binding. Our AI assistant, during the briefing, may mention typical plans for guidance, but does not provide binding prices — final confirmation is always made by the Team before any charge.

5. Payment

Payment for the creation plan is made in full before the start of development, through the Stripe payment platform. The following payment methods are accepted: credit/debit card (Visa, Mastercard, Amex), Apple Pay, Google Pay, MB WAY, Revolut Pay, Samsung Pay, Klarna (3 interest-free instalments), Link and PIX.

All payments are securely processed by Stripe. Webfy does not store card data or financial information on its servers.

6. Right of Withdrawal

Under Decree-Law No. 24/2014 (Portugal) and equivalent EU consumer protection legislation, the consumer has the right to terminate the contract within 14 days from the date of payment, without needing to provide a reason.

Important note about our free Demo model: as the Client only pays after approving the Demo, the Demo development phase is entirely free and is not subject to the right of withdrawal. After payment, if the Client requested to publish the Demo immediately OR requested specific changes that involve personalised work, the service is considered started/executed at the Client's express request, losing the right of withdrawal in that specific part.

To exercise the right of withdrawal within the above deadline and conditions, the Client must contact Webfy by email at geral@webfy.pt. The refund will be made within a maximum of 14 days after receipt of the request, through the same payment method used for the purchase. In partial cases (part of the work already executed), the Team may propose a proportional partial refund, without prejudice to the Client's right to resort to legal means.

7. Creation Process

The Site creation process follows these steps, within the free Demo pre-payment model:

  1. AI-assisted Briefing — the Client converses with our AI assistant, which proposes a structure for the site. The Client can validate or request up to 3 iterations. If no agreement is reached after 3 iterations, the conversation is automatically routed to the Team via scheduled call.
  2. Alternative: Briefing by direct call — the Client may also choose, from the start, to book a call with the Team instead of using the AI assistant.
  3. Demo Development (free) — Webfy creates the Demo (1st real, functional page) based on the provided briefing. At no cost to the Client.
  4. Client Review — the Demo is made available to the Client for review and approval on the dashboard, at a temporary URL.
  5. Payment (only if Client approves) — after Demo approval, the Client pays the plan for the Team to continue work or publish immediately.
  6. Continuation or publication — after payment, the Client chooses between publishing the Demo immediately, requesting changes or scheduling a refinement call.

Delivery Timelines

  • Free Demo (1st page): typically 24-72 hours after the complete briefing (varies with request volume)
  • Starter (after approved Demo): up to 72 hours after payment and materials delivered
  • Pro (after approved Demo): 5 to 10 business days after payment and materials delivered
  • Custom: timeline agreed individually

The indicated timelines are estimates and depend on timely delivery of materials (texts, images, logo if applicable) by the Client. Delays in content delivery by the Client may extend the development timeline.

8. Approval and Delivery

The Client's approval of the Site on the dashboard constitutes formal acceptance of the delivery of the contracted service. After approval, the Site is automatically published on Webfy's free hosting.

If the Client wishes to make changes before approving, they can request revisions through the ticket system on the dashboard. Webfy is committed to fulfilling revision requests within the limits included in the contracted plan.

9. Revisions and Changes

Each plan includes a limited number of free revisions during the development and review phase. Revisions must be requested through the ticket system on the dashboard.

Changes that exceed the plan's free revision limits, or that involve substantial changes to the original project scope (structural changes, additional features, complete redesign), will be quoted separately and subject to prior agreement between the parties.

After approval and publication of the Site, any changes are considered additional maintenance and may be charged separately.

10. Hosting

During the Demo review phase, the Demo runs on Webfy's internal infrastructure at a temporary URL — this URL serves only for the Client to evaluate the work and does not constitute contractable hosting. Hosting (free or paid) only becomes available after the Client approves the Demo and pays for the plan.

Free Hosting

After Demo approval and payment, all Sites created by Webfy benefit from free hosting, which includes:

  • Webfy subdomain (e.g., name.sites.webfy.pt)
  • Free SSL certificate (HTTPS)
  • "Built by Webfy" branding bar at the top of the Site

Free hosting has no time limit as long as Webfy operates the service.

Paid Hosting (Upgrade)

The Client can upgrade to paid hosting, which includes removal of the branding bar and the ability to use a custom domain. Monthly prices:

  • Unified hosting: €19.90/month (Starter and Pro)
  • Premium (legacy): €29.90/month — only for clients who contracted this plan before 2026

Upon Site approval, the Client receives a 1-month free upgrade coupon. The subscription is automatically renewed and can be cancelled at any time through the billing portal.

11. Payment Default on Paid Hosting

In case of failure to pay the hosting subscription, the following procedure applies:

  • Day 1: email notification informing of the payment failure
  • Day 3: second notification warning of risk of losing the custom domain
  • Day 7: final warning before automatic downgrade
  • Day 14: the Site is automatically reverted to free hosting — the custom domain is removed and the branding bar is reactivated. The Site remains online on the Webfy subdomain.

The Site is never deleted due to payment default — it is only reverted to free hosting. The Client can regularise payment at any time to restore the upgrade.

12. Cancellation and Termination

The Client can cancel the paid hosting subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period, keeping the service active until that date. After cancellation, the Site reverts to free hosting.

The Client can request complete deletion of their account and associated data at any time by contacting Webfy by email. After deletion, Webfy maintains a data backup for 30 days, after which all data is permanently deleted, unless legally required to retain it (namely for tax purposes).

Webfy reserves the right to terminate the contract and remove the Site if the Client:

  • Violates these Terms of Service
  • Uses the Site for illegal, fraudulent purposes or purposes that violate third-party rights
  • Publishes content constituting defamation, hate speech, pornography or violence
  • Uses the Site for malware distribution, phishing or spam

13. File Export

The Client can request the development files of their Site through the dashboard. By requesting the export, the Client acknowledges that:

  • Webfy does not provide installation, configuration or maintenance support for the Site outside its infrastructure
  • The Client assumes full responsibility for hosting and maintaining the Site externally
  • Updates, security patches and backups are no longer Webfy's responsibility

14. Intellectual Property

Client Content: all texts, images, logos and materials provided by the Client for the creation of the Site are and remain the property of the Client. Webfy uses these materials exclusively for the provision of the contracted service.

Code and design: the source code, design and technical components of the Site created by Webfy are delivered to the Client as part of the contracted service. The Client has full right of use of the delivered Site. Webfy retains the rights to its platform, internal tools and pre-existing intellectual property.

Portfolio: Webfy reserves the right to use screenshots and descriptions of the created Site for portfolio and promotional purposes, unless the Client expressly requests otherwise.

15. Content Responsibility

The Client is solely responsible for the content published on their Site, including texts, images, videos, links and any other materials. The Client guarantees that:

  • They hold the necessary rights to all content provided
  • The content does not violate copyright, trademarks or other intellectual property rights of third parties
  • The content is not illegal, defamatory, fraudulent or harmful
  • The content complies with applicable Portuguese and European legislation, including the GDPR

The Client agrees to indemnify and hold Webfy harmless from any liability, claim or damage resulting from the content published on their Site.

16. Use of Artificial Intelligence

Webfy uses artificial intelligence tools to support development, with the aim of delivering the Site faster and more efficiently. Every project is always reviewed and validated by human professionals before delivery to the Client.

The use of AI does not replace human supervision nor diminish Webfy's responsibility for the quality of work delivered under the contracted plan.

17. Support and Communication

Client support is provided through two channels:

  • WhatsApp — main communication channel for general questions and project follow-up
  • Dashboard tickets — for revision requests, changes and technical questions

Webfy is committed to responding to most queries within 24 hours on business days (Monday to Friday, excluding national holidays). This timeframe is indicative and does not constitute a binding contractual service level agreement (SLA).

18. Availability and Limitation of Liability

Webfy will use best efforts to keep the platform and hosted Sites available continuously. However, Webfy does not guarantee uninterrupted availability and cannot be held liable for:

  • Temporary interruptions for maintenance, updates or improvements
  • Failures in third-party services on which Webfy depends (Stripe, hosting providers, DNS, SSL certificates)
  • Force majeure events (natural disasters, network failures, cyber attacks)
  • Indirect, consequential damages or lost profits resulting from the use or inability to use the services

Webfy's total liability to the Client, for any cause and regardless of the form of action, is limited to the total amount paid by the Client in the 12 months prior to the event giving rise to the claim.

19. Personal Data Protection

The processing of personal data by Webfy is governed by our Privacy Policy, which forms an integral part of these Terms of Service. By accepting these terms, the Client confirms they have read the Privacy Policy.

20. Changes to Terms of Service

Webfy reserves the right to change these Terms of Service at any time. Significant changes will be communicated to the Client by email with at least 15 days' notice. Continued use of the services after the changes take effect constitutes acceptance of the new terms.

21. Applicable Law and Dispute Resolution

These Terms of Service are governed by Portuguese law. For the resolution of any disputes arising from the interpretation or execution of these terms, the parties submit to the jurisdiction of the competent Portuguese courts, without prejudice to the use of legally established alternative dispute resolution mechanisms.

The consumer Client may use the European Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr.

23. AI-Assisted Briefing

Webfy provides a conversational AI assistant to support the Client in defining the site structure. This assistant is powered by AI technology provided by Anthropic (Claude model).

  • The Client acknowledges that messages exchanged with the AI assistant are processed by Anthropic for the sole purpose of generating the assistant's response
  • Content generated by the AI assistant (suggested structure, feature descriptions, plan indications) is suggestive and non-binding in nature
  • Final prices, scope and included features are always confirmed by the Webfy Team before any charge or execution of work
  • Webfy does not guarantee the accuracy or completeness of suggestions generated by the AI assistant — all proposals are reviewed by human professionals before delivery
  • The Client may, at any time, choose to communicate directly with the Team instead of using the AI assistant (simply request a call with the Team)

24. Additional Services

The base plans (Starter, Pro, Custom) include only what is specified on the pricing page and in the proposal sent by the Team. Work outside that scope is considered additional services with extra cost and is always presented as a separate proposal before any execution.

  • Logo creation (when the Client does not yet have their own logo)
  • Professional copywriting (text written by the Team instead of provided by the Client)
  • Professional business photography
  • Non-automatic translations (human review or translation from scratch)
  • Specific integrations with third-party systems (CRMs, ERPs, niche booking platforms, etc.)
  • Maintenance beyond the timeframes included in the plan
  • Additional complex features (members area, multi-vendor, advanced e-commerce configurations)

Examples of additional services (non-exhaustive list):

No additional service is executed without prior written approval from the Client, based on a proposal with price and estimated timeline sent by the Team.
